What is LINX?

   is the foremost guide to New Zealand caselaw and legal writing for the last 20 years, created by the law society libraries for lawyers. All New Zealand legal researchers use LINX!

It is a 'digest' database which summarises cases, articles and books. Library staff, legally or professionally qualified, from the three contributing libraries write headnotes for the cases and index the books and journals. LINX currently consists of approximately 170,000 such records. When you search LINX you quickly get an overview of New Zealand law.

LINX is available online, on CD and at the Auckland, Wellington and Canterbury District Law Society Libaries plus a number of other District Law Society Libaries around New Zealand.

Coverage of judgments

In building the LINX database, the library staffs at Auckland, Wellington and Canterbury District Law Societies strive to obtain all judgments of the High Court, Court of Appeal and Supreme Court plus selected judgments from lower courts.

Most judgments are supplied directly to the libraries by the courts and all of those are entered onto LINX as soon as possible unless suppression requirements or court orders prevent that. Others are requested from the court when sought by library users or if staff are otherwise alerted to their existence. In earlier years, judgments were less reliably obtained. There is no complete list of all proceedings in New Zealand courts and accordingly no way to check that all judgments have been received for adding to LINX.

Texts and rare books

LINX includes the combined textbook catalogues of the three contributing libraries with holdings.

Why search an index rather than the full text of the cases?

Searching full text cases well is difficult. The databases are huge and you have to be really good at searching to narrow down what you want. The judge may be eloquent but may never have thought about anyone searching her words and may never even mention the standard words you need to search on. It may be so obvious to the parties that the issue is "land law" that those crucial words never appear in the judgment, only the more specific ones relating to the case. The judgment won’t use the name the case later becomes commonly known by. An example of this is the "Winebox" litigation.

The headnoters and indexers work in a library where people are using LINX. They know users remember cases by popular names and want the legal concepts listed tidily so that they can find them. What you are searching is a much smaller document and much more manageable than the full text. On Linxplus you are able to link to the full text from the LINX record for most Supreme Court, Court of Appeal and High Court judgments for the last 10 years.
